Q: Are these supposed to be wore as underwear, under a short?

They're marketed as a "liner" short, meaning they're intended to go under other clothing, i.e. with no underwear. However, they are not meant for cycling or mtb, but for motocross/dirt biking. Hence the 'strange' location of the 'huge' chamois – it's in the right place and size for a moto, not a mtb.

Q: i have a 36-38" wast line. What size?

XL, they are spandex but they fit me nice and snug and I wear 36-38 depending on brand.

Get the XL. I have a 32 inch waist and the Large size fits perfectly snug. Gotta think about the leg openings too. Mine are tight in a good way. I am 5’10” 180.

I'm a 32 inch waist and wear a medium. Large should be fine because they need to be snug. XL would definitely be too big.
