It's a llittle unclear if this goes on top of the old drain, or one has to be taken out first?

I agree with Minos. My drain is flush with the tub and is just a big giant hole that allows everything to go down it (like this http://pix.soundwag.com/web/drain.jpg). This sits right on top. There is a slight curve to this, and it sits curve side up. If you have the type of drain that also acts as the stopper and sticks up into the tub (like this http://s2.hubimg.com/u/5464035_f248.jpg), this will not work on that.

Wondering if I can try for kitchen sink. Hate how most sink strainers back up the flow of water. Will this one slow down the water flow?

I'm not sure if the size will be the same. It doesn't slow down water flow in the shower, until hair starts to collect. I have med long hair, & I tend to have hair fall out during every shower, so I take my toe and move any collected hair out away from the drain.
